UCT (Unfair Contract Terms)

Regime under the ACL + ASIC Act prohibiting unfair terms in standard form contracts.

From 9 November 2023, the UCT regime carries pecuniary penalties — up to $50M / 30% turnover per unfair term. Applies to standard form contracts with consumers and small businesses (<100 employees or <$10M turnover). Each unfair term can be a separate contravention.
